遗嘱及财产规划

我工作中最有趣事情是帮助客户草拟遗嘱及财产规划。 我很荣幸可以与我的客户讨论他们如何积累资产并且计划未来在他们过世后如何把资产移交给他们所指定的受益人。 在许多情侣关系当中, 无论是已婚或长期同居的情侣通常会聘请我为他们准备一份共同遺囑。多数的时候, 他们双方都会对我说 “自我死后，我希望把一切都交给我的配偶” 。 然后，两人相视一笑，我在一旁看着这一幕他们为彼此充满的爱。 然而，作为律师, 我需要他们考虑现实问题：如果他们有年幼的孩子，但是选择将一切都交给他的配偶，这其中会出现一些问题。 如果他们的配偶将来选择再婚，那么他们的新配偶将会拥有分享这些财产的权力，而这也会损害他们孩子的利益. 这个问题经常使情况变得非常有趣。多数的女方最常会想到的是：“哦，对的，我丈夫一定会很快迎娶一位年轻漂亮的女孩，然后我的孩子将会失去我所想要遗留给他们的遗产”。而男方通常会觉得他的妻子会为了哀悼她所爱的丈夫而保持单身。 我曾有一位客户每年都会与她的丈夫去邮轮旅行，两人也非常幸福。很不幸的是她的丈夫去世了。 她告诉我她仍然继续与丈夫一起乘船旅游。我当时感到非常困惑, 并问她怎么可能。她告诉我：当她去航游的时候, 她会带着她丈夫的骨坛一起去。” 哇!”  我说，” 你太爱你的丈夫了”。我紧接着问她在游轮上做什么，她说她去跳舞，过后我没有再追问。但是六个月后，她又回来找我并且吩咐我为她准备一份新的遗嘱。你问原因？因为她要嫁给一位她在游轮上认识的男士。 所以, 你永远不知道未来会发生什么。但是你能做的是向优秀的律师咨询并从中获得对你而言最佳的建议。这样才能够确保您的资产得到保护并适当的赠予您所爱之人。
